The Massachusetts Supreme Judicial Court has clarified its recent gay marriage ruling in time for the state’s upcoming Constitutional Convention. (See also.) I’m holding my breath, waiting for the conservative shit to hit the fan. The big battle for equal rights might well begin in earnest now and there’s plenty of reason to fear social conservatism. Look at the CWA’s obsession with “the homosexual agenda.” Look at Ohio’s bigotry. And look at a Kansas appellate court’s blatant refusal to apply its sex crimes law equally, even after the highest court in the nation gives it a second chance to do so. (And talk about judicial activism — just look at the judge’s reasoning.)
Yes, I’m feeling both ready for and fearful of what’s to come. I don’t think it’s going to be a pretty and neat as Andrew Sullivan argues it could be, and I think we’re eventually going to walk away from this knowing just how discriminatory and prejudicial America can be. For now, I’m strengthening my faith at the fount of Julian Bond.
